
Meta, the operator of Facebook, has ultimately lost the lawsuit it filed against the Personal Information Protection Commission (PIPC) regarding the imposition of a 6.7 billion KRW fine.
According to the legal community on the 13th, the Supreme Court dismissed Meta’s lawsuit seeking to overturn the fine, corrective order, and public disclosure measures imposed by the PIPC. As a result, Meta must comply with the PIPC's actions and will be subject to an inspection to verify the implementation of the corrective order.
In November 2020, the PIPC found that Meta had provided the personal information of at least 3.3 million users to third parties without their consent and imposed a fine of 6.7 billion KRW.
Investigations revealed that when Facebook users accessed services from other businesses, not only their own data but also their friends' personal information was shared. The data included sensitive personal details such as educational background, work history, place of origin, family status, relationship status, and interests.
This practice continued for approximately six years, from May 2012 to June 2018, and at least 3.3 million out of the 18 million Facebook users in South Korea had their personal information shared without authorization.
In response, Meta argued that the information was shared voluntarily by users and that Facebook did not force this transfer. The company also claimed that the fine was excessive and filed a lawsuit in March 2021.
However, both the first and second trials, as well as the Supreme Court, ruled that the PIPC’s actions were lawful and rejected Meta’s claims.
The PIPC stated, "With the enforcement of the measures now resumed following the ruling, we will ensure that Meta fully complies with the corrective order and will rigorously monitor its implementation."
